A System Can Work Exactly as Designed and Still Do Harm
We're taught to ask whether the system was followed. The harder question is whether the design itself is fair.
There’s a sentence that gets used to end conversations: “the process was followed.” It’s meant to settle things. The forms were filled in, the steps were taken, the rules were obeyed — so whatever happened must be fair.
I’ve come to distrust that sentence. Not because process doesn’t matter — it matters enormously — but because “the process was followed” answers a much smaller question than the one people are actually asking. It tells you the machine ran. It doesn’t tell you the machine was built right.
Two different questions
When something goes wrong inside an institution, there are two separate things to ask:
- Was the system followed?
- Is the system, followed correctly, actually fair?
Most public argument collapses these into one. Defenders point to the first to dismiss the second. “Everyone got their day in court, the rules were applied evenly” — true, perhaps, and beside the point if the rules themselves tilt the floor.
A system can run exactly as designed and still produce outcomes that are slow, ruinously expensive, lopsided toward whoever can afford the better-resourced side, and brutal on the people caught in the middle. That’s not a malfunction. That is the design, working.
The cost is paid by people, not institutions
Institutions are good at absorbing criticism without feeling it. A delay is a line on a docket to a court and a year of someone’s life to the person waiting. A cost is a budget item to a department and a house sold to the family paying it. The system experiences these as data. People experience them as the actual texture of their lives.
That gap — between how a system measures itself and how it lands on a human being — is where most of the real injustice lives. Not in dramatic corruption. In ordinary, procedurally-correct grinding.
Criticising the design isn’t attacking the people
Here’s the line I try hard to hold. You can believe deeply in the rule of law, in due process, in the presumption of innocence — and still think a particular system is built badly. Pointing at a broken incentive or a lopsided design is not the same as attacking the individuals working inside it, most of whom are doing their best within constraints they didn’t set.
In fact, taking systems seriously means being willing to say: this could be true and that could be true at the same time. The people can be acting in good faith and the structure can be producing bad outcomes. Refusing to separate those two things is how nothing ever gets fixed.
What “doing better” looks like here
It looks like judging systems by their results on real people, not by whether they ticked their own boxes. It looks like resisting the comfort of “the process was followed” as a final answer. And it looks like being able to hold institutions to account without pretending the humans inside them are villains.
A fair system should be able to survive that scrutiny. If it can’t — if the only defence on offer is that the rules were obeyed — then the rules are exactly what we should be talking about.
